Luis Fernando Fernandez-Lima, a 22-year-old Latino, was fatally shot Tuesday, Sept. 6, in the 600 block of South La Fayette Park Place in Westlake, according to Los Angeles County coroner’s records.

Shortly before 5 p.m., Fernandez-Lima got into a confrontation with another person at a park, said Los Angeles Police Lt. John Radtke.

The other person pulled out a gun and shot Fernandez-Lima in what police believe was a dispute over gang membership, Radtke said.

Fernandez-Lima was taken to a hospital where he was pronounced dead at 5:31 p.m., according to coroner’s records.

Fernandez-Lima may have been claiming membership to the local gang in that area, but investigators haven’t found any evidence that he was from that gang, Radtke said.

Police identified the suspect as Jose Antonio Garcia, a 36-year-old Latino, Radtke said.

Garcia was charged Sept. 13 with one count of murder and one count of possession of a firearm by a felon, according to the Los Angeles County district attorney’s office.

Garcia pleaded not guilty Sept. 28 and is due in court Nov. 22, prosecutors said.
